ALLIANCE FOR NUCLEAR RESPONSIBILITY’S REPLY TO RESPONSES TO ITS AMENDED PETITION FOR MODIFICATION OF D.14-11-040

What really went on during the secret meetings between SCE and former CPUC president Peevey in Poland??

SCE’s July 3, 2015 Response to ALJs’ Ruling of June 26, 2015 provides additional detail from Pickett’s multiple contemporaneous blackberry messages during the March 27, 2013 dinner40 to two SCE colleagues in the United States: Polly L. Gault, Executive Vice President of Public Affairs at Edison International, and Elizabeth Matthias, a Senior Attorney at SCE. Although some of the exchanges are fully or partially redacted as non-responsive to the ALJs’ Ruling, the Pickett messages which SCE has provided include:

  • From Pickett to Gault at 11:06 p.m. Warsaw time:Subject: Re: Sent the wrong attachment earlier. Here’s the agenda. Sorry.I agree. You should stop sending me annoying e mails. So there. I expect to never hear from you again. So there. From Poland sitting next to Peevey, God help me. So there. Yes, I am moderately intoxicated. Thank God !
  • From Pickett to Matthias at 11:26 p.m. Warsaw time: Subject: Re: Heaven Help Us!Redacted-NonResponsive Sitting next to Peevey taking in the last formal evening of the trip Redacted-NonResposive

In the ongoing scandal over covert meetings and emails between SCE and the CPUC regarding the settlement in the San Onofre fiasco, the Alliance has filed a reply to SCE’s claims of immunity:

060115 A4NR Response to SCE reply to motion

The Alliance for Nuclear Responsibility has filed an Amendment to Petition for Modification of the CPUC decision placing the burden of paying for the fiasco caused by the failed steam generator replacement at San Onofre (SONGS) onto the ratepayers.  At issue: the ongoing revelations of secret, unreported meetings between former CPUC President Michael Peevey and SCE’s executives and the manner by which they have unduly influenced the decision…. From the Alliance’s lastest filing:

Juxtaposed against SCE’s unlawful and unethical decision to violate its disclosure obligations, each of the other four principal claims in SCE’s April 29, 2015 Response is both irrelevant and diversionary. The prejudicial impact on the other I.12-10-013 parties, both settling and non-settling, which stemmed from SCE’s misconduct — and the resultant extrinsic fraud and fraud-by-concealment – is all that matters regarding the integrity of D.14-11-040.

The Alliance for Nuclear Responsibility has filed amended motion for sanctions against Southern California Edison (SCE) in the wake of an ongoing release of formerly secret emails between SCE and the California Public Utilities Commission that may have prejudiced the multi-billion dollar settlement in the closing of San Onofre.

The San Diego Union Tribune reports:

The release of the emails started with an earlier filing by Alliance attorney John Geesman:

The San Diego Union Tribune

The California Public Utilities Commission on Tuesday ordered Southern California Edison to turn over all documents related to the potential settlement of the San Onofre closure dated between March 2013 and November 2014….

…A group called the Alliance for Nuclear Responsibility called on regulators to sanction Edison for the late filing, and the order for release of emails is part of the commission’s consideration of that request.
